Between Holland and Bonaire, Saba, and St. Eustatius

Memorandum of Understanding on the Future Constitutional Status of Bonaire, St. Eustatius, and Saba Agreed During the Mini-Conference Held on October 10 & 11, 2006, in The Hague

The delegations of:

  • the Netherlands
  • the island territory of Bonaire;
  • the island territory of St. Eustatius;
  • the island territory of Saba,

in the presence of the delegation of the Netherlands Antilles, which attended the conference as an observer, and in view of the future and the welfare of the populations of the three islands, have in mutual consultation agreed as follows

Whereas:

  • on 22 October 2005 the Netherlands, the Netherlands Antilles and the five island territories have concluded an Agreement of Principles, annexed to which was a Declaration of Intent signed by the Netherlands, Bonaire, St. Eustatius and Saba;
  • in the Agreement of Principles it has been agreed that the Netherlands Antilles will cease to exist as a distinct governmental entity; 
  • during the initial Round Table Conference of date 28 November 2005 it has been agreed that the intended goal for the island territories of Bonaire, St. Eustatius and Saba will be a new status of its own kind (sui generis) within the Kingdom, based on a direct link with the Netherlands;
  • the responsibility for the realization of human rights, the rule of law and good governance on Bonaire, St. Eustatius and Saba will be assumed by the Netherlands as of the moment the Netherlands Antilles will have been dismantled, at which time the islands will obtain a direct link with the Netherlands;
  • on 18 September 2006 the Council of State of the Kingdom issued an advisory opinion on the reformation of the constitutional relationship of the Antillean islands within the Kingdom, and in particular the constitutional status of the islands of Bonaire, St. Eustatius and Saba;
  • the Netherlands, Bonaire, St. Eustatius and Saba wish to conclude directional agreements about the constitutional status of the three islands in accordance with the general principles set out in the Council’s advisory opinion;
  • the public finances of the islands will have to be put in order, to give the islands a good starting base;
  • the agreements set out in these final conclusions will have to be included - unabridged - in the intergovernmental agreement to be concluded within the framework of the future constitutional structures of Curaçao and St. Maarten;
  • the target date for concluding this intergovernmental agreement is 1 January 2007.
    In the unlikely event that this date cannot be reached, the Netherlands and the three islands will immediately confer with each other, in the presence of the Netherlands Antilles as an observer, to decide what measures to take;
  • it is considered desirable that the government of the Netherlands Antilles agrees with the agreements set out in these final conclusions before they are implemented, seeing that the three islands still form part of the Netherlands Antilles;
  • the main aim which the three islands and the Netherlands wish to attain with these agreements, is to offer the population a prospect to a better future, particularly for the youth of these three islands.

A. CONSTITUTIONAL STATUS AND INTERNAL CONSTITUTIONAL
STRUCTURE

1.  Bonaire, St. Eustatius and Saba will obtain a new constitutional status within the constitution of the Netherlands. This can be effected by constituting the islands as public entities within the meaning of article 134 of the [Dutch] Constitution.

2.  The legal provisions relating to Dutch municipalities will be analogously applied, with due observance of certain specific provisions to be enacted by law or by virtue of this law. These specific provisions will be drafted in mutual consultation between the Netherlands and the
three islands.

3.  The future internal constitutional structure of Bonaire, Saba and St. Eustatius will be uniform. The system of government shall be dualistic. The dualistic system may be introduced gradually.

4.  The three islands shall comply with criteria for good governance comparable to those required from Dutch municipalities. To this end criteria have already been formulated in the annex to the letter of date 7 March 2006 from the general secretary of the RTC Preparatory Committee.
The entry into force of these criteria will be determined in the step-by-step plan (cf. section 26 below).

5.  When the new constitutional status enters into force, the existing Netherlands Antillean legislation in effect in the three islands will remain in effect. This legislation will gradually be replaced by Dutch legislation. However, in view inter alia of the population size of the
three islands, the great [geographic] distance to the Netherlands and the insular character of the three islands, special provisions deviating from the Dutch legislation will be enacted. A careful analysis will be made to determine what kind of deviations will be required.

6.  As of the moment the islands will have obtained a constitutional status within the Dutch constitution, the residents of the three islands who have the Dutch nationality will be allowed to exercise the right to vote for the [Dutch] Second Chamber and the European Parliament.
Provision will be made for participation in the elections for the [Dutch] First Chamber (= Senate). 

B.  BANDWIDTH FOR WORKING OUT THE NEW STATUS AND DIRECT LINK WITH THE NETHERLANDS

Assignment of tasks/responsibilities and level of public facilities/benefits

7.   Point of departure will remain that as many tasks/responsibilities as possible will be carried out on the insular level (principle of subsidiarity). Within this framework a budget scan and task analysis will be carried out, to gain more insight into the financial capacity of the small islands. The quick scans carried out at the request of the task force Direct/New Links in the fields of education, public health and social security will be included in this study.

8.   The [number of] tasks and concomitant powers to be carried out by the islands can differ for each island. In due course and upon [prior] evaluation, tasks/responsibilities and concomitant powers assigned to an island can be changed.

9.   If responsibilities are carried out in co-operation with other countries within the Kingdom, the Netherlands will be responsible for the co-operation on behalf of the islands.
The tasks/responsibilities in question will be determined in mutual consultation between the Netherlands and the three islands.

10. The level of public facilities/benefits as determined by the Havermans-Committee - to be brought up-to-date within the framework of the Social Economic Initiative which will be drawn up on the basis of the methodology and indicators as applied by this committee – will be the point of departure.

Police and judiciary 

11. In the new constitutional set-up the Netherlands will be responsible for law enforcement and the administration of justice on Bonaire, Saba and St. Eustatius.

12. Law enforcement will be organized by the Netherlands in co-operation with the other countries within the Kingdom, in order to guarantee its quality, capacity and integrity.  

13. In the new constitutional set-up the Common Court of Justice of the Netherlands Antilles and Aruba (under a different name) will remain in charge of the administration of justice in Bonaire Saba and St. Eustatius. 

Financial and economic matters

14. In the new constitutional set-up Bonaire, Saba and St. Eustatius shall have a balanced budget, as well as a balanced long-range perspective. At the outset of the new constitutional set-up the budget must be balanced in accordance with internationally accepted budgetary principles, as are applied also by the Dutch government. As is the case at present, in the new constitutional set-up the islands will not be authorized to borrow money.

15. In the new constitutional set-up the financial structure set out in the Financial Interrelations Act will be analogously applied in the three islands. Special provisions will in any case be enacted with respect to financial supervision. 

16. A study will be made to determine in what way unforeseen investments may be made possible in the new constitutional set-up.

17. In the new constitutional set-up financial supervision will be exercised by the Netherlands to ensure compliance with the financial norms by the three islands.

18. A study will be conducted to determine the official currency, as well as how monetary and banking supervision will be organized in the three islands. This study will in any case consider the economic consequences of the choice of currency, inter alia for the tourist and
commercial sectors.

19. A study will be conducted to determine which fiscal regime should be adopted and to determine whether the Dutch Internal Revenue Service should assume responsibility for the imposition, collection and inspection of taxes. Customs will also be included in this study.
The possibility and desirability for Saba and St. Eustatius to maintain their ‘free port’ status will also be studied. A limiting condition will be that the fiscal legislation and regime must be and remain in conformity with the international norms to which the Kingdom is bound.

20. A study will be conducted to determine in what way in the new constitutional set-up structural [financial] support – for as long as necessary – will be given to the three islands, inter alia in   
the fields of social security, pensions and public health, with a view to setting up a system making a structurally maintainable level of facilities/benefits possible.

Regional contacts / co-operation     

21. Co-operation between Bonaire, Saba and St. Eustatius and foreign countries and/or islands within the region can be helpful to organize public facilities efficiently and to gain economic advantages. Such co-operation and the formalization thereof can only be realized through the intermediary of the Minister of Foreign Affairs and the course of the co-operation will have to be carefully monitored by the Ministry of Foreign Affairs.

Relationship with Europe 

22. A study will be conducted to investigate the possibility for the three islands to obtain the UPT-status, as well as the implications thereof. 

Evaluation

23. Five years after the three islands will have obtained a new constitutional status within the constitution of the Netherlands, the implementation of the new constitutional set-up will be evaluated by the Netherlands and the three islands.

C. AGREEMENTS WITH RESPECT TO THE TRANSITIONAL PROCESS AND THE INTERIM PERIOD

24. As agreed in the Agreement of Principles of date 22 October 2005, the Netherlands Antilles and the five islands shall comply with all their obligations consequent on the present constitutional arrangement until the Netherlands Antilles will have been dismantled. The Netherlands will guarantee such compliance within the existing parameters of the Kingdom Statute.

25. Within this framework a study will be made to determine in what way the Netherlands and the three islands can co-operate in the process of ensuring that the three islands will have a sound base to start from. To attain this sound starting base it is in any case important that the islands take short term financial and economic measure, such as:

  • The recommendations of the task force General Financial Position with respect to the administration of public finances will be implemented forthwith. The Netherlands will lend effective support in this. 
  • In connection herewith supervision of the public finances of the three islands will become effective as from the outset of the transitional process. This will be regulated by general kingdom decree. The supervisory body will be given adequate powers to instruct and approve. The supervision will be related inter alia to the quality of the budget, the assumption of obligations, accountability and payment transactions. 
  • Apart from putting the administration of public finances in order, it is also important that the islands will have economic growth. To accomplish this, the three islands and the Netherlands will draw up a Social Economic Initiative (SEI). In this plan the special ecological circumstances of the islands will, among other things, be taken into account. The reports in this field will be finalized and approved forthwith, following which the recommendations will be implemented. The Netherlands will lend effective support in this. As part of the SEI a budget scan will be conducted. The results of this scan will provide guidelines for the adaptation and adoption of the 2007 budget. In the SEI the level of public facilities/benefits will be brought up-to-date in accordance with the methodology and indicators set out by the Havermans-committee.

26. The Netherlands together with the three islands and the Netherlands Antilles will draw up a step-by-step plan to organize the transitional process. This step-by-step plan will indicate what steps are to be taken by the various entities during the period up to the moment the new constitutional set-up will enter into force, as well as a time-schedule indicating when each step is to be taken. The initiative for the implementation of the various steps will also be taken by the Netherlands. The step-by-step plan will be ready for approval not later than 1 January 2007. The plan will at least include the following action items:

  • The formulation of the legal provisions required to regulate the status of the islands within the constitution of the Netherlands (cf. section 1);
  • The formulation of the criteria for good governance (cf. section 4);
  • An analysis of the [Dutch] legislation suitable for application in the three islands, as well as the set-up of a system to enact such legislation (cf. section 5);
  • A task analysis and budget scan, to determine which tasks/responsibilities are to be carried out by and/or for the three islands including an estimate of the cost involved therewith. A start will be made with this not later than 1 December 2006 (cf. section 7);
  • Conducting of studies with respect to the fiscal regime, currency choice, structural financial supervision and structural financial support (cf. sections 15 through 19);
  • Conducting of a study with respect to structural [financial] support – for as long as necessary – to be given to the three islands, inter alia in the fields of social security, pensions and public health (cf. section 20);
  • Conducting of a study with respect to the possibilities and implications of obtaining the UPT-status by the three islands (cf. section 22);
  • The implementation of the recommendations with respect to the Administration of Public Finances, financial supervision during the interim period and the finalization, adoption and implementation of the SEI-reports (cf. section 25).

Abovementioned action items will be included in the work to be carried out within the framework of the SEI and the administration of public finances.

On the basis of these and possible additional studies the Netherlands and the three islands together with the Netherlands Antilles will decide on the allocation of tasks and responsibilities and the application of legislation in the new constitutional set-up and will determine how and in accordance with which time schedule these tasks and responsibilities will be transferred and the legislation will enter into force.

20. 26. Hulanda huntu ku e tres islanan i e pais Antia Hulandes ta traha un plan na etapa pa regla e proseso transitorio. E plan na etapa aki ta kontené un lista di trabounan ku mester wòrdu hasí pa e diferente entidatnan durante e periodo interino te na e momentu ku e situashon estatal nobo lo drenta na vigor, inkluso un taimplèn indikando ki fecha e diferente trabounan aki mester keda kla. Hulanda lo tuma e inisiativa pa implementá e diferente trabounan aki. E plan na etapa lo keda kla pa aprobashon mas tardá dia 1 di yanüari 2007.   • Implementashon di e rekomendashonnan riba tereno di finansa públiko, introdukshon di supervishon finansiero durante e periodo interino i finalisashon, aprobashon i implementashon di e rapòrtnan di ISE (mira punto 25)
